Welcome to NextEmail.ai. These Terms of Service ("Terms") govern your access to and use of the NextEmail.ai service ("Service"), operated by NextEmail.ai ("we," "our," or "us"). By accessing or using our Service, you agree to be bound by these Terms.

By creating an account or using NextEmail.ai, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

NextEmail.ai is an AI-powered email intelligence platform that provides:

• Email Organization: Automatic classification and folder organization using AI
• Security Scanning: Detection of phishing, spam, and malicious content
• Smart Search: Natural language search across your email archive
• Multi-Provider Support: Integration with Gmail, Microsoft 365, and other email providers

The Service requires you to authorize access to your email accounts through OAuth authentication. You maintain full control over this access and can revoke it at any time.

3. Account Registration

3.1 Eligibility

You must be at least 16 years old to use NextEmail.ai. By using the Service, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

3.2 Account Information

You agree to:

• Provide accurate and complete registration information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized account access

3.3 Account Security

You are responsible for all activities that occur under your account. We recommend using a strong, unique password and enabling any available security features.

4. Email Access Authorization

4.1 OAuth Permissions

To use NextEmail.ai, you must authorize access to your email accounts. When you connect an email account, you grant us permission to:

• Read your email messages and metadata
• Create, modify, and manage folders/labels
• Move emails between folders
• Access your email address and profile information

4.2 Scope of Access

We only request the minimum permissions necessary to provide our Service. We do not:

• Send emails on your behalf without explicit action
• Delete your emails (unless you explicitly request it)
• Share your email content with third parties
• Access email accounts you haven't connected

4.3 Revoking Access

You can disconnect email accounts or revoke our access at any time through:

• The NextEmail.ai Settings page
• Your email provider's security settings

5. Acceptable Use

5.1 Permitted Use

You may use NextEmail.ai for lawful purposes related to managing your personal or business email communications.

5.2 Prohibited Use

You agree NOT to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Reverse engineer, decompile, or attempt to extract our source code
• Use the Service to send spam or unsolicited communications
• Impersonate another person or entity
• Use automated means to access the Service (except through our official APIs)
• Resell or redistribute the Service without authorization

6. Subscription and Billing

6.1 Free Trial

We offer a free trial period for new users. The trial includes limited features and usage. Trial terms may change at our discretion.

6.2 Paid Subscriptions

Paid plans are billed in advance on a monthly or annual basis. Prices are subject to change with notice. Current pricing is available on our website.

6.3 Refunds

We offer refunds within 14 days of initial purchase if you are not satisfied with the Service. Contact support to request a refund.

6.4 Cancellation

You may cancel your subscription at any time. Upon cancellation:

• You retain access until the end of your billing period
• No further charges will be made
• Your data remains accessible until you delete your account

7. Intellectual Property

7.1 Our Property

NextEmail.ai, including its software, design, logos, and content, is our proprietary property protected by intellectual property laws. You may not copy, modify, or distribute our intellectual property without written permission.

7.2 Your Content

You retain all rights to your email content. By using the Service, you grant us a limited license to process your emails solely to provide the Service. This license terminates when you delete your account.

8. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimer of Warranties

While we strive to provide accurate AI-powered email classification and security scanning, we do not guarantee:

• 100% accuracy in email classification
• Detection of all phishing or malicious emails
• Continuous, uninterrupted service availability

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXTEMAIL.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless NextEmail.ai, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights

12. Termination

12.1 By You

You may terminate your account at any time through the Settings page or by contacting support. Upon termination, your data will be deleted within 30 days.

12.2 By Us

We may suspend or terminate your account if:

• You violate these Terms
• Your account is used for illegal activities
• You fail to pay subscription fees
• We discontinue the Service (with reasonable notice)

13. Dispute Resolution

13.1 Informal Resolution

Before filing any formal dispute, you agree to contact us at support@nextemail.ai to attempt informal resolution.

13.2 Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

13.3 Arbitration

Any disputes not resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Class action lawsuits and class-wide arbitration are not permitted.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and NextEmail.ai regarding the Service.

14.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

14.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

14.4 Assignment

You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
